Poiché gli AMC non sono vincolanti, le persone soggette a regolamentazione possono scegliere mezzi alternativi di rispondenza. In tal caso, tuttavia, esse perdono la presunzione di conformità fornita dagli AMC dell'AESA e devono dimostrare alle autorità competenti di rispettare effettivamente la regolamentazione.
