Scope of application

Regulation (EU) 2023/2405 ‘ReFuelEU Aviation’ (RFEUA) applies to European Union airports that handle more than 800,000 passengers or 100,000 tonnes of freight per year (Art. 3.1 RFEUA).
Following Switzerland’s adoption of the RFEUA, Zurich and Geneva airports will be subject to the same requirements as Union airports from 1 January 2026. As it is situated on French territory, Basel Mulhouse (Euroairport, EAP) is already categorised as a Union airport.
 

Duties

Union airports – including Zurich and Geneva airports, which fall under the scope of Article 3.1 RFEUA – can play a key role in helping aircraft operators to comply with refuelling obligations. In this context, the management bodies of these airports should plan personnel and infrastructure resources (e.g. sufficient and qualified staff, refuelling capacity, fuel-feed systems, refuelling vehicles and hydrant systems) in a way that makes it easier for aircraft operators to adhere to their obligation under Article 5.1 RFEUA.

Exemptions

Due to their geographical characteristics, some airports (e.g. those on islands) may not have the necessary infrastructure and/or aviation fuel supplies and are therefore unable to allow ongoing refuelling to the same extent as other airports with more resources. Under the special circumstances set out in Article 5.3 RFEUA, aircraft operators may apply for temporary exemption from the refuelling obligation for certain routes connecting airport islands without rail or road links to Union airports.
Applications must be submitted to the competent authority (as defined in Art. 11.6 RFEUA) at least three months before the planned commencement date.
